Terms and Conditions of Registration as a Client

For the purposes of these Terms and Conditions of Registration:

“The Agency” means Almikleen Home Services, ABN 74695792971 and any other entity to which the Agency otherwise assigns its rights;

“Client” means any person or persons for whom the Agency has allocated an Independent Domestic Cleaning Contractor within the last twelve (12) months regardless of how they are introduced to the Agency; and

“Placement Fee” means the commission or fee payable by a Client of the Agency to the Agency for its placement service, which placement fee may be varied by the Agency from time to time on the giving of no less than two (2) weeks’ notice.

“Cleaner” means an Independent Domestic Cleaning Contractor that the Agency has allocated to a Client within the last twelve (12) months regardless of how they are introduced to the Agency.

By submitting my application as a Client to the Agency for its consideration, I confirm my agreement to the terms and conditions of the Agency’s privacy policy and to Almikleen Home Services Terms and Conditions of Registration listed below.

1. Flat Rate Cleaning Services:

1.1. The Client will be provided with an amount owing to the Agency, which the Client has confirmed is the amount that they will pay. The amount is due on the day of the clean before the cleaning commences. 

1.2. The Client is required to provide credit or debit card details that the Agency will use to process payment for the cleaning service which was performed. The card details will be processed using Stripe card processing. The Stripe terms and conditions can be found by clicking HERE or pasting the full link into an internet browser. 1.3. The Agency will process an initial deposit if required. The deposit will be processed using the card details to confirm that the card details are correct and are able to be used. The deposit amount is not refundable. A refund of the deposit is completely at the Agency’s discretion. 

1.4. The service will not be confirmed until the deposit has been confirmed by the Agency as being received. If no payment of the deposit is received, the cleaning service can be cancelled by the Agency due to non-payment.

1.5. The remaining balance owed by the Client will be processed on the day that the cleaning is to be performed.

1.6. If the Client does not make payment on the remaining balance, it remains due to be paid by the Client, until the Agency relieves the Client of the debt owed to the Agency. 

1.7. If a Chargeback is processed on either the deposit or the remaining balance, it remains as being due to be paid by the Client, until the Agency relieves the Client of this debt owed to the Agency.

1.8. The Agency reserves the right to cancel any service at any time for any reason without penalty of any kind, to the Agency.

1.9. The Agency reserves the right to proceed with a formal debt collection process, which may be resolved using a formal court hearing if the debt remains unpaid.  The debt collection process and resolution can include late fees, interest at 10% per annum, court fees, administration fees, and any other debts incurred as a result of the debt being owed to the Agency. The Agency also reserves the right to organise for a debt collection agency to collect the debt. 

1.10. If the cleaning service is cancelled within 24 hours of the scheduled commencement time, the Agency reserves the right to charge a cancellation fee that may cover any lost income to the Agency or the Cleaner, which may be the full value of the service. The amount to be charged as a cancellation fee is decided at the discretion of the Agency. 

1.11. If you have chosen to provide a vacuum and mop equipment for the cleaning service, this equipment must be in good working order and deemed suitable by the Cleaner and the Agency. If they are deemed unsafe, or unsuitable, the charge for the cleaning service will be amended to the amount that includes using the Cleaner’s vacuum and mop.

1.12. You agree to provide a safe working environment to the Cleaner when they are at your home. We do not tolerate any violations of the law, or any behavior that is lewd or aggressive, or perceived as such. The Cleaner and the Agency has the right to cancel at any time if they choose for any reason.

1.13. You understand that the Flat Rate Cleaning Service / Package Deals are not hourly rate bookings. There is no minimum hourly timeline that the Cleaner is required to be at your property. 

1.14. Additional cleaning services should be requested prior to the cleaning day. The Cleaner and the Agency reserve the right to decline any offer of additional work that has not been pre-arranged and confirmed. 

1.15. If you want to dispute the workmanship or service, you should alert the Cleaner on the day prior to them leaving the property, as the first contact. This gives the Cleaner opportunity to correct the issue while they are at the property. If you did not have the opportunity to discuss with the Cleaner, you need to make contact with the Agency within 24 hours providing detail and photographs of the issue. The Agency will organise for the Cleaner to return to rectify that issue. If the original Cleaner refuses to rectify the issue, the Agency may send another Cleaner. The decision of whether the cleaning has been performed to our guaranteed standard, remains with the Agency at all times. The Agency may determine the issue not able to be rectified further, or beyond the scope of work. The Agency may decide that you are owed a refund. Any refund is at the sole discretion of the Agency. 

2. Hourly Rate Cleaning Services

2.1. The Client will be provided with an amount owing to the Agency, which the Client has confirmed. The Client will be provided with a Service Agreement outlining the following:

  • The amount to be charged,
  • The payment terms,
  • What funding will be used to pay the invoices,
  • Other terms and conditions relative to the kind of funding that will be used to make payment.

2.2. The Agency may use the details that you have provided to contact the funding provider to verify the funding method is available for you to use for the purpose of the cleaning service that you have booked. 

2.3. The service will not be confirmed until funding details have been received. If no funding details have been received, the cleaning service can be cancelled by the Agency.

2.4. An invoice for the services will be sent to your funding manager on the day of the cleaning service after the cleaning service has been performed.

2.5. If the funding provider does not make payment on the invoice, it remains due to be paid by the Client, until the Agency relieves the Client of the debt owed to the Agency. 

2.6. The Agency reserves the right to cancel any service at any time for any reason without penalty of any kind, to the Agency.

2.7. The Agency reserves the right to proceed with a formal debt collection process, which may be resolved using a formal court hearing if the debt remains unpaid.  The debt collection process and resolution can include late fees, interest at 10% per annum, court fees, administration fees, and any other debts incurred as a result of the debt being owed to the Agency. The Agency also reserves the right to organise for a debt collection agency to collect the debt. 

2.8. 2.11. You understand that there is no quality guarantee on Hourly Rate Cleaning Services. The Cleaner will be at your property for the duration of the time you have booked and they will be available to provide cleaning services during that time. 

2.12. Additional cleaning services should be requested prior to the cleaning day. The Cleaner and the Agency reserve the right to decline any offer of additional work that has not been pre-arranged and confirmed. 

2.13. If you want to dispute the workmanship you are welcome to let the Cleaner know if you would like an issue rectified. If there is enough time left in your booking, they can rectify that. Otherwise, you will need to book more time. If you did not have the opportunity to discuss with the Cleaner, you need to make contact with the Agency within 24 hours providing detail and photographs of the issue. The Agency will let the Cleaner know about the issue and provide training to the Cleaner if possible.  The decision of whether the cleaning has been performed to standard, remains with the Agency at all times. The Agency may determine the issue not able to be rectified further, or beyond the scope of work. The Agency may decide that you are owed a refund or won’t be invoiced for the time.  Any refund is at the sole discretion of the Agency. Any time that is not invoiced, is at the sole discretion of the Agency.

3. All Cleaning Work

3.1. Our Agency provides Public Liability, and Workers Compensation Insurance to our Employees only. Any Independent Cleaning Contractor that we organised on behalf of you will agree upon registration that they have adequate insurances for the services that they are providing. They are bound by the agreement that they have agreed to and we do not accept any responsibility for those Independent Cleaning Contractors violating the agreement that they have made with us. 

3.2. Our Agency will request a criminal history check be provided to us prior to commencing work. This applies to both our prospective Employees and the Independent Cleaning Contractors. These workers will not be allowed to view Client details, or work on Client jobs until we have received this document. 

3.3. You will not attempt to engage our workforce to work directly for you. All services are to be requested through the Agency and the Agency is entitled to its fee for services.

3.4. Should you engage our workers to work for you directly, we will terminate any ongoing services. We will also issue an invoice to you for our ‘Agency Services’ where we have found and provided your new worker. This fee is $1200.00 AUD including GST. This invoice is due within seven (7) days of the issue date. You will not engage any worker, or accept any offer of service provision from a worker, that you were introduced to via our Agency for a period of twelve (12) months after you have ceased using our Agency services. 

3.5. You will report to the Agency any offer that a worker has made to you for working where the Agency is not to be paid its Agency fees.

3.5. The Agency reserves the right to proceed with a formal debt collection process, which may be resolved using a formal court hearing if the debt remains unpaid.  The debt collection process and resolution can include late fees, interest at 10% per annum, court fees, administration fees, and any other debts incurred as a result of the debt being owed to the Agency. The Agency also reserves the right to organise for a debt collection agency to collect the debt. 

3.4. We do not accept cash for work performed under any circumstances. All payments must be made to the Agency directly. The Agency makes payment to its workforce. 

3.5. I consent to my name, phone number, referee comments and any other notes kept by the Agency being given by the Agency to any of its workers for the purpose of providing cleaning services. I expressly waive any rights which I may have in relation to that information.

3.6. I authorise the Agency to retain on file, any relevant documents that the Agency has requested in order to provide services, or to facilitate payment.

3.7. You will not provide a key to your property for the Cleaner to take home. If you provide instructions for a key or security code, these must be provided to the Agency and then the Agency will provide those instructions to the Cleaner. The Cleaner is not responsible for the key, after the Cleaner has left the property.

3.8. You agree that your house is not in a state of squalor, hoarding, or severe mould infestation. You understand that these situations constitutes an unsafe working environment. You understand that we have the right to decline the work, or re-estimate the cost for the cleaning if we decide to take it on. If any of these situations exist in your property, it is your responsibility to communicate this to us prior to the booking being confirmed. 

3.9. Almikleen Home Services respects your privacy. We use information collected from you to offer you with Cleaners and to improve and expand our relationship with you. Refer to our Privacy Policy Statement for more information about what we do with your information.
